Addressing Disproportionate Representation through Research Based Approaches

The Individuals with Disabilities Education Act of 2004, Part B, requires states and local education agencies to take steps to address the disproportionate representation in special education. Federal Regulations provide for the collection and examination of data to determine if disproportionality based on race and ethnicity is occurring with respect to:

  • the identification of children as children with disabilities including children with disabilities with particular impairments,
  • the placement in particular settings, and
  • the incidence, duration, and type of disciplinary actions, including suspensions and expulsions
